Stopping Foreclosure by Filing for Bankruptcy
If you've fallen behind on your mortgage payments and can't catch up with your arrears (late or missed payments), filing for Chapter 13 bankruptcy may allow you to stop foreclosure and get back on track with your current payments and spread your missed payments out over a three- to five-year period.
Filing for Chapter 13 bankruptcy immediately stops your lender from moving forward with foreclosure. Once you have a Chapter 13 repayment plan, your lender cannot foreclose on your home as long as you comply with the terms of the bankruptcy.
The protection of the bankruptcy court means that Chapter 13 is often a better alternative to negotiating a voluntary workout agreement with your mortgage company. Likewise, if you simply cannot afford to keep your home, filing for Chapter 7 bankruptcy may give you more protection than the short sale process.
